Regulatory Framework for Non-Personal Data Proposed:

A committee has been constituted by the Ministry of Electronics and Information Technology to study and provide suggestions regarding the non-personal data (NPD). The report was given by the committee in July 2020 and it recognized that the management of NPD is necessary and essential for innovation, privacy concerns and to prevent the harm.

Key Recommendation:

There are 3 kinds of NPDs – public, private and community. Public NPD is the data collected by the government agencies, community NPD is the anonymised data and the private NPD is the data related to a person or entity.

A regulatory authority is to be established to;

1.Ensure that the NPD is shared for the innovation in the country and to

2.Enforce rules and regulations

The report also proposes to regulate the following stakeholders:

1.Data principal

2.Data custodian

3.Data trustees

4.Data trusts

The Committee has also provided regarding the data sharing, data ownership and data storage. It is pertinent to note that the recommendations given by the committee would help the Indian and foreign entities to do business in India. There would be some additional compliance that has to be followed by the business entities including the law enforcement.

Conclusion:

Thus, the report given by the committee paves a way for more efficient business in India and the inclusion of foreign businesses as well.
